Welcome to Smokin Heights. By accessing or purchasing from our website, https://www.smokinheights.com.au/, you agree to the following Terms and Conditions. Please read them carefully before placing an order.

1. General

These Terms and Conditions apply to sales made through the Smokin Heights website and catalogue.

By placing an order, you agree to be bound by these Terms and Conditions.

Smokin Heights reserves the right to update or amend these Terms and Conditions from time to time. Any changes will apply to orders placed after the updated terms are published on our website.

2. Minimum Order Value

A minimum order of $50.00, excluding postage and handling, applies to all purchases.

Orders below this minimum may not be processed.

3. Product Guarantee and Consumer Rights

All iris plants supplied by Smokin Heights are freshly dug and true to name.

If you are unhappy with your plants, please contact us within 10 days of receiving your order where possible, and provide photographs of the plants and any relevant concerns. This helps us assess and resolve issues promptly.

This notification timeframe does not limit any rights you may have under the Australian Consumer Law.

We are not responsible for plants that fail to establish or perform where this is caused by unsuitable growing conditions, incorrect planting, neglect, or poor aftercare once they are in the customer's possession, except where otherwise required under the Australian Consumer Law.

Mould on Plants

Each plant is inspected before being packed and dispatched, and we take care to ensure plants are in good condition when they leave the nursery.

From time to time, plants may develop some surface mould as a result of transport and storage conditions. Surface mould does not necessarily indicate that an iris is unhealthy and will generally not affect its viability or performance.

If you receive plants with mould or have any concerns about the condition of your plants, please contact us with photographs. Each case will be assessed individually and we may provide care advice, a replacement, refund, or other appropriate remedy.

4. Product Availability and Substitutions

All varieties are subject to availability.

Product Quantity Limits

Some varieties or products may be subject to a stated quantity limit where stock is particularly limited. Any applicable limit will be displayed on the relevant product listing and may apply per customer, household or delivery address.

Customers must not attempt to circumvent a stated quantity limit by placing multiple orders, using multiple accounts or customer details, or otherwise purchasing quantities in excess of the stated limit.

Smokin Heights may, at its discretion, allow an individual customer to purchase a quantity greater than the stated limit. Any such allowance is discretionary and applies only to the specific order or circumstances for which it is granted. It does not constitute a change to the published quantity limit or create an entitlement to purchase additional quantities.

Where an order exceeds a stated quantity limit, or a quantity limit that Smokin Heights has agreed to allow, Smokin Heights may cancel or refund the quantities exceeding the applicable limit and return those products to available stock.

Where a customer places multiple orders or otherwise attempts to circumvent a quantity limit, Smokin Heights may consolidate or cancel affected orders or quantities.

Where correcting an order that exceeds a quantity limit requires additional administrative or restocking work, Smokin Heights may recover reasonable costs incurred in processing, reviewing, adjusting, cancelling, consolidating or returning affected stock to availability.

Any administration or restocking amount charged under this section will be limited to reasonable and proportionate costs actually incurred and will not be applied as a penalty for breaching these Terms and Conditions.

Repeated or deliberate attempts to circumvent quantity limits may result in affected orders or quantities being cancelled.

Products in Your Cart

Adding a product to your shopping cart does not reserve or guarantee that product for you.

Products remain available for purchase by other customers until your order has been successfully completed and payment has been received. If another customer completes their purchase of a product before you, that product may become unavailable and will be removed from your cart.

We recommend completing your order promptly, particularly for varieties with limited quantities available.

We will not substitute a variety without the customer's permission where a substitution preference has been provided.

Where a substitution is agreed to, the replacement variety will be of equal or greater value.

As some varieties may sell quickly, customers may nominate acceptable substitutions when placing their order.

If a requested variety is unavailable and no suitable substitution has been authorised, the unavailable item will be refunded.

5. Pricing and Payment

All prices are in Australian Dollars (AUD) and include GST where applicable.

Unless otherwise stated, all prices listed for iris varieties are for one (1) rhizome.

A minimum order of $50.00, excluding postage and handling, applies to all purchases.

Payment must be made in full before an order is dispatched.

As some varieties may sell quickly, customers are encouraged to pay promptly to secure their selections.

We accept:

  • PayPal: A PayPal invoice will be sent to the email address provided. A PayPal account is not required to make payment by card through the invoice.

  • Credit Card: Visa, Mastercard and American Express.

  • Direct Deposit: Bank details will be provided with your order or upon request.

6. Shipping and Delivery

Our regular shipping season runs from January through to April.

Orders are processed on a first come, first served basis and are dispatched progressively throughout the shipping season.

Due to the seasonal nature of our business and the number of orders received, Smokin Heights works to a maximum packing and dispatch capacity. Placing an order on the first day that the store opens does not mean that your order will necessarily be dispatched at the beginning of the shipping season.

Orders are worked through progressively as we are able to prepare, dig, pack and dispatch them. Your order may be posted at any time during the January to April shipping period.

We appreciate your patience while we work through orders carefully and ensure that plants are dug, prepared and packed appropriately for dispatch.

Postage Rates

Our postage rates are based on the number of rhizomes in your order.

SA, VIC, NSW and QLD

  • 1–10 rhizomes — $25.00

  • 11–20 rhizomes — $32.50

  • 21–40 rhizomes — $40.00

  • 41+ rhizomes — $50.00

WA and TAS

  • $55.00 flat rate, including the applicable phytosanitary certificate.

Orders shipped to Tasmania or Western Australia may be subject to inspection by the relevant state or territory biosecurity authority upon arrival.

Where an inspection fee or other biosecurity charge is imposed by the relevant authority, this charge is not covered by the Plant Health Assurance Certificate (PHAC), phytosanitary certificate, or other documentation supplied by Smokin Heights. Any such fees or charges are the responsibility of the customer and must be paid directly to the relevant government department or authority.

Smokin Heights is not responsible for inspection fees or other charges imposed by the relevant biosecurity authority after dispatch.

Large orders may require multiple parcels. Where additional postage is required, customers will be contacted and any additional postage must be paid before dispatch.

Customers are responsible for selecting the correct postage option for their state and order size. Orders where insufficient postage has been paid may be delayed until the correct postage has been paid.

Customers must provide a complete and accurate delivery address. Once an order has been handed to the postal carrier, delivery is subject to the carrier's handling and delivery processes. Smokin Heights is not responsible for delays caused by the postal carrier or for loss or damage occurring during transit, except where otherwise required under the Australian Consumer Law.

Customers should inspect their order promptly upon arrival and contact Smokin Heights as soon as reasonably possible if they believe there is an issue with the plants or the order. Photographs may be requested to assist with assessing the issue. Customers should also follow any care instructions provided.

7. Order Changes and Cancellations

Customers may request changes or cancellations to an order within 7 days of placing the order.

After this period, orders may be considered final as stock allocation, preparation and packing may already be underway.

Requests made after 7 days will be considered at the discretion of Smokin Heights. Where a cancellation is requested outside these guidelines and can be accommodated, a reasonable cancellation fee may apply to cover costs already incurred in processing and preparing the order.

Any refund approved for a cancellation will generally be processed using the original payment method.

Nothing in these Terms and Conditions limits or excludes any rights a customer has under the Australian Consumer Law.

8. Gift Vouchers and Promotions

Gift vouchers are available from $50.00.

From time to time, Smokin Heights may offer promotional gifts or other incentives. The conditions applying to each promotion will be specified at the time the promotion is offered.

Unless otherwise stated, promotional offers cannot be exchanged for cash or transferred to another customer.

9. Returns and Refunds

Due to the perishable and seasonal nature of live plants, we generally do not accept returns for change of mind.

If an item is faulty, damaged, incorrectly supplied, or not as described, please contact us within 10 days of receipt where possible and provide photographs where appropriate. This notification timeframe does not limit any rights you may have under the Australian Consumer Law.

Where a plant has been affected by an issue covered under our Product Guarantee, the matter will be assessed on a case-by-case basis. Depending on the circumstances, we may provide care advice, a replacement, refund, partial refund, or another appropriate remedy.

All refunds, replacements and remedies will be provided in accordance with the Australian Consumer Law.

10. Liability and Plant Performance

Smokin Heights takes care to supply healthy, freshly dug and true-to-name plants.

However, live plants are affected by environmental conditions and their subsequent care. We cannot guarantee establishment, growth, flowering, performance or other outcomes once plants are in the customer's care where the outcome is affected by conditions outside our control.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

11. Intellectual Property

All content on the Smokin Heights website and in our catalogue, including text, photographs, images, graphics, designs and other materials, is the property of Smokin Heights or is used with permission.

Content may not be copied, reproduced, modified, republished, distributed or used commercially without prior written permission from Smokin Heights, except where permitted by law.

12. Governing Law

These Terms and Conditions are governed by the laws of South Australia and the applicable laws of the Commonwealth of Australia.
